Ballot paper
The ballot papers and the envelopes for the postal ballot shall be officially produced under the
authority of the government. In
Bundestag elections, the ballot paper shall contain:
- for elections in the constituency, the names of the candidates from the
approved constituency nominations; in the case of constituency nominations by parties,
also the names of these parties as well as any shortened form of their names they may use; in
respect of other constituency nominations, also the distinctive identifying word,
- for Land list elections, the names of the parties and any shortened form of their names if such
form is used by them, as well as the family names and forenames of the first five candidates from
the approved Land lists.
Legal bases:
Bundestag election: Section 30 (1) and (2) of the Federal Elections Act (BWG), Section 45 (1)
of the Federal Electoral Regulations (BWO)
In
European elections, the ballot paper shall contain:
- the names of the parties as well as any shortened form of their names if such a form is used by
them and, in the case of other political associations, their names and their distinctive code names
if such a name is used by them,
- the designation of the nominations as Land lists or combined lists for all Länder and, in the
case of Land lists, the Land for which the nomination was made, and
- the forenames and family names of the first ten candidates of the nominations admitted, their
occupations or positions, the municipality of their place of residence (main place of residence)
and, in the case of candidates for combined lists, also the abbreviation of the Land in which the
municipality of the place of residence is located.
Thus the ballot papers used in European elections differ as follows from those used in
Bundestag elections:
- Each voter has only one vote.
- Only lists are voted for, not individual candidates.
- For each nomination (list), the ballot paper specifies whether the list has been compiled for a
specific Land or as a combined list for all Länder.
- Not only the first five candidates are named but the first ten.
Legal bases:
European election: Sections 15, 16 of the European Elections Act (EuWG); Section 38 of the
European Electoral Regulations (EuWO)
