  1) Pursuant to Article 39 (1), third sentence, of the Basic Law, new (regular) elections shall be held no sooner than forty-six months and no later than forty-eight months after the electoral term begins. The electoral term of the 17th German Bundestag began with its constituent meeting on 27 October 2009. The earliest date for holding the election to the 18th German Bundestag would be 28 August 2013 (forty-six months after the start of the electoral term), the latest date would be 27 October 2013 (forty-eight months after the beginning of the electoral term).

The Federal President determines the election day. It must be a Sunday or a statutory public holiday within that period (compare Section 16 of the Federal Elections Act).
 
There are special periods for early elections when the German Bundestag has been dissolved.
