Political parties

The Basic Law grants constitutional status to political parties. They participate in the formation of the political will of the people. Political parties may be freely established. Their internal organization must conform to democratic principles. As a consequence, parties play an outstanding role when it comes to democracy and popular sovereignty in the Federal Republic of Germany. In past decisions, the Federal Constitutional Court consistently described the political parties as “integrative components of the constitutional structure and constitutionally organised political life.”
