Repeat of the 2021 Bundestag election: final election result to be established anew

WIESBADEN/BERLIN – The 2021 election to the German Bundestag will be repeated in 455 of Berlin’s 2,256 polling districts on 11 February 2024. On account of the repeat election, the result of the election to the 20th German Bundestag will be established anew. This may result in individual changes in seats in the German Bundestag, also across Länder. Even though the repeat election is limited to Berlin geographically, there may also be new seat gains or losses in Länder other than Berlin.

Final election result will be established on 1 March 2024

Due to the election re-run in Berlin, the Federal Electoral Committee must establish the final result of the 2021 Bundestag election anew in public session on 1 March 2024. This will take account of the new results determined by the constituency electoral committees and the Land Electoral Committee in Berlin. In the remaining Länder, the results established by the constituency electoral committees and Land Electoral Committees in 2021 will remain unchanged. The Federal Electoral Committee continues to be bound by these established results.

Individuals who, as successors from the list of candidates, have become Bundestag members since the 20th constituent session of the German Bundestag will keep their seats after the overall election result has been established anew. However, in the process of newly establishing the overall election result nationwide, the individuals originally elected in 2021 will once again be confirmed as elected even though their seats have since been filled by successors from the list.  This occurs if the individuals originally elected have died, are no longer eligible to stand for election, have refused to take their seat or have resigned their seat. When establishing the overall election result anew, the Federal Electoral Committee can decide to make reference to succession from the list for the individuals concerned.

Any resignation of party membership or change of party that took place after the admission of the lists of candidates submitted by the parties for the 2021 Bundestag election will not affect the establishment of the results by the Federal Electoral Committee. This also applies if an individual leaves a party or switches to another party after the repeat election but before the attainment of Bundestag membership. The individuals concerned will be declared to be elected for the parties for which they ran.

Council of Elders decides on loss of seats

If the Federal Electoral Committee finds that Bundestag members are no longer elected due to changes in the election results, the Council of Elders of the German Bundestag will decide ex officio on the individual’s loss of membership. These Bundestag members leave the Bundestag with the decision of the Council of Elders.
